By downloading, installing, accessing, or using the WaterBunny application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not download, install, or use the App.
These Terms constitute a legally binding agreement between you and Popcorn Labs Inc. (“we,” “us,” “our”) governing your use of the App. These Terms supplement, and do not replace, Apple’s Licensed Application End User License Agreement (EULA) and Apple’s Terms and Conditions for the App Store.
We may update these Terms from time to time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
WaterBunny is an iOS application that helps you log daily water intake, track progress toward a hydration goal, and review your hydration history over time. The App offers the following features:
WaterBunny offers an optional Pro upgrade, including additional animal themes, extended insights views (Week, Month, and Year), electrolyte tracking, and the ability to edit past entries.
All in-app purchases are processed by Apple through the App Store. By making a purchase, you agree to Apple’s Terms and Conditions, including Apple’s payment and refund policies. Popcorn Labs Inc. does not directly process, store, or have access to your payment information.
The Pro upgrade is offered as a one-time (non-subscription) purchase. Prices are displayed in the App and may vary by region based on Apple’s pricing tiers. We reserve the right to change pricing at any time, though changes will not affect purchases already completed.
Refund requests for in-app purchases must be directed to Apple, as Apple processes all transactions. You may request a refund through Apple’s Report a Problem page at https://reportaproblem.apple.com or by contacting Apple Support. Popcorn Labs Inc. cannot issue refunds for App Store purchases.
You may restore previously purchased premium features on any device signed into the same Apple ID used for the original purchase. Use the “Restore Purchases” option within the App’s paywall screen.
All content within the App — including but not limited to animal silhouette designs, visual designs, user interface elements, icons, graphics, animations, and software code — is the property of Popcorn Labs Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, Popcorn Labs Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble any part of the App or its content. You may not use the App or its content for any commercial purpose without prior written consent from Popcorn Labs Inc.
You agree to use WaterBunny solely for personal, non-commercial purposes and in compliance with all applicable laws. You agree not to:
With your explicit permission, WaterBunny reads and writes the following Apple HealthKit data types:
HealthKit access requires your explicit authorization through Apple’s standard permission prompt. You may grant or revoke HealthKit permissions at any time through your device’s Settings > Health > Data Access & Devices.
In compliance with Apple’s HealthKit guidelines and App Store Review Guidelines:
HealthKit data written by WaterBunny persists within Apple Health independently of the App. Uninstalling WaterBunny does not delete data previously written to Apple Health. To manage or delete HealthKit entries, use the Apple Health app.
WaterBunny integrates with the following third-party services. Your use of these services is subject to their respective terms and privacy policies:
TelemetryDeck — Privacy-first analytics service used to collect anonymous, aggregate usage data. TelemetryDeck does not collect personally identifiable information, IP addresses, device identifiers, or health data. Privacy policy: https://telemetrydeck.com/privacy/
Apple StoreKit — In-app purchase processing handled entirely by Apple under Apple’s Terms and Conditions.
Popcorn Labs Inc. is not responsible for the practices, content, or availability of third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. POPCORN LABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Popcorn Labs Inc., its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.
In no event shall Popcorn Labs Inc.’s total aggregate liability exceed the amount you have paid to Popcorn Labs Inc. for in-app purchases in the twelve (12) months preceding the claim, or fifty U.S. dollars (USD $50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Popcorn Labs Inc., its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
You may stop using the App at any time by uninstalling it from your device. Uninstalling the App removes all locally stored app data.
Popcorn Labs Inc. reserves the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice, and without liability to you. We may also release updates that change features or available content.
Upon termination or discontinuation, your license to use the App ends. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — shall survive.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and Apple’s Licensed Application End User License Agreement, constitute the entire agreement between you and Popcorn Labs Inc. regarding your use of the App, and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the App.

These Terms of Service apply to the WaterBunny iOS application published by Popcorn Labs Inc. They do not apply to any third-party websites, applications, or services linked from within the App.
