By downloading, installing, accessing, or using the Soothe application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not download, install, or use the App.
These Terms constitute a legally binding agreement between you and Popcorn Labs (“we,” “us,” “our”) governing your use of the App. These Terms supplement, and do not replace, Apple’s Licensed Application End User License Agreement (EULA) and Apple’s Terms and Conditions for the App Store.
We may update these Terms from time to time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

Soothe is a wellness application that provides guided calming techniques for informational and educational purposes only. Soothe is NOT:
The techniques offered by Soothe — including paced breathing, grounding exercises, progressive muscle relaxation, dive reflex activation (cold splash), distanced self-talk, yoga nidra, and gratitude meditation — are drawn from evidence-based practices. However, their inclusion in this App does not constitute medical advice, clinical recommendation, or therapeutic intervention.
If you are experiencing a mental health crisis, having thoughts of self-harm or suicide, or are in immediate danger, please do not rely on this App. Instead, take one of the following actions immediately:
Soothe is not monitored by mental health professionals and cannot provide real-time crisis support. The App is not designed to replace emergency services or crisis intervention by trained professionals.
The cold splash technique (dive reflex activation) involves applying cold water or cold packs to the face to activate the mammalian dive reflex. This technique has known medical contraindications and may pose serious health risks for individuals with certain conditions, including but not limited to:
You must consult your physician or qualified healthcare provider before using the cold splash technique, particularly if you have any pre-existing medical condition. If you experience chest pain, difficulty breathing, dizziness, or any adverse reaction while using this technique, stop immediately and seek medical attention.
Some techniques in Soothe involve controlled breathing patterns, physical relaxation, or altered states of awareness (such as yoga nidra). If you have any medical condition — including respiratory, cardiovascular, neurological, or psychiatric conditions — consult your healthcare provider before using the App. Discontinue use of any technique that causes discomfort, pain, dizziness, or distress and consult a healthcare professional.
Use of Soothe does not create a patient-provider, therapist-client, or any other professional healthcare relationship between you and Popcorn Labs or any of its employees, contractors, or affiliates.
Soothe is an iOS application that guides users through evidence-based calming techniques using pre-recorded professional voice narration and text-to-speech synthesis. The App offers the following features:
Soothe offers optional premium features, including additional narration voices, font themes, and color themes, available for purchase within the App.
All in-app purchases are processed by Apple through the App Store. By making a purchase, you agree to Apple’s Terms and Conditions, including Apple’s payment and refund policies. Popcorn Labs does not directly process, store, or have access to your payment information.
Premium features are offered as one-time (non-subscription) purchases. Prices are displayed in the App and may vary by region based on Apple’s pricing tiers. We reserve the right to change pricing at any time, though changes will not affect purchases already completed.
Refund requests for in-app purchases must be directed to Apple, as Apple processes all transactions. You may request a refund through Apple’s Report a Problem page at https://reportaproblem.apple.com or by contacting Apple Support. Popcorn Labs cannot issue refunds for App Store purchases.
You may restore previously purchased premium features on any device signed into the same Apple ID used for the original purchase. Use the “Restore Purchases” option within the App’s settings.
All content within the App — including but not limited to audio scripts, voice recordings, breathing pattern designs, visual designs, user interface elements, icons, graphics, animations, and software code — is the property of Popcorn Labs or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
Voice narration audio in Soothe is produced using ElevenLabs voice synthesis technology. The resulting audio content is owned by Popcorn Labs and is used under license in accordance with ElevenLabs’ terms of service.
Subject to your compliance with these Terms, Popcorn Labs grants you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble any part of the App or its content. You may not extract, download, or re-use audio files, scripts, or other media from the App. You may not use the App or its content for any commercial purpose without prior written consent from Popcorn Labs.
You agree to use Soothe solely for personal, non-commercial purposes and in compliance with all applicable laws. You agree not to:
With your explicit permission, Soothe reads and writes the following Apple HealthKit data types:
HealthKit access requires your explicit authorization through Apple’s standard permission prompt. You may grant or revoke HealthKit permissions at any time through your device’s Settings > Health > Data Access & Devices.
In compliance with Apple’s HealthKit guidelines and App Store Review Guidelines:
HealthKit data written by Soothe persists within Apple Health independently of the App. Uninstalling Soothe does not delete data previously written to Apple Health. To manage or delete HealthKit entries, use the Apple Health app.
Soothe integrates with the following third-party services. Your use of these services is subject to their respective terms and privacy policies:
TelemetryDeck — Privacy-first analytics service used to collect anonymous, aggregate usage data. TelemetryDeck does not collect personally identifiable information, IP addresses, or device identifiers. Privacy policy: https://telemetrydeck.com/privacy/
ElevenLabs (via AIProxy) — Text-to-speech synthesis used as a fallback when pre-recorded audio is unavailable. Only pre-written app script content is transmitted for voice synthesis; no user-generated content or personal data is sent. AIProxy acts as a secure relay to protect API credentials.
Apple StoreKit — In-app purchase processing handled entirely by Apple under Apple’s Terms and Conditions.
Apple Speech Framework — On-device speech recognition used during certain guided exercises. Audio is processed locally and is not transmitted to external servers (subject to Apple’s speech recognition terms).
Popcorn Labs is not responsible for the practices, content, or availability of third-party services. If any third-party service becomes unavailable, certain App features may be affected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. POPCORN LABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
The calming techniques and informational content provided through the App are offered for general wellness purposes only and are not guaranteed to be effective for any individual user or condition.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Popcorn Labs, its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.
Popcorn Labs shall not be liable for any adverse physical, psychological, or emotional effects resulting from your use of any technique or feature within the App, including but not limited to breathing exercises, cold splash (dive reflex activation), progressive muscle relaxation, or any other guided exercise.
You acknowledge and agree that you use the App and its techniques at your own risk. You assume full responsibility for your physical and mental health decisions, including the decision to use or discontinue any technique offered by the App.
In no event shall Popcorn Labs’ total aggregate liability exceed the amount you have paid to Popcorn Labs for in-app purchases in the twelve (12) months preceding the claim, or fifty U.S. dollars (USD $50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Popcorn Labs, its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
You may stop using the App at any time by uninstalling it from your device. Uninstalling the App removes all locally stored app data.
Popcorn Labs reserves the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice, and without liability to you. We may also release updates that change features, techniques, or available content.
Upon termination or discontinuation, your license to use the App ends. Sections of these Terms that by their nature should survive termination — including the Medical Disclaimer, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of ______, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in ______, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the App.
